The Products sold by Notperfectfancy are subject to the conditions of legal guarantees provided for by articles L.217-4 et seq. of the Consumer Code, as well as by articles 1641 to 1649 of the Civil Code, to the exclusion of all other guarantees.

Legal guarantee of conformity

NOTPERFECTFANCY undertakes to deliver to the Customer a Product conforming to its description and free from defects in conformity, in the sense that the Product will be suitable for the use usually expected of a similar good and that it will present the characteristics described during the sale. In the event of non-conformity of the Product, the Customer has a 2-year warranty from delivery of the latter(s). Defects in conformity which appear within 24 months of delivery are presumed to exist at the time of delivery, unless proven otherwise. NOTPERFECTFANCY can, however, combat this presumption if it is not compatible with the nature of the Product or with the lack of conformity invoked by the Customer. The Customer may choose between repair and replacement of the Product, unless one of these choices results in a manifestly disproportionate cost for NOTPERFECTFANCY. If repair or replacement of the Product is impossible, the Customer may have the price paid and return the Product, or keep the Product and have part of the price refunded, unless the lack of conformity is minor. The repair, replacement or reimbursement of the Product will take place at no cost to the Customer and does not preclude the possible award of damages – in the event that the Customer is entitled to it.

13.2. Guarantee against hidden defects

NOTPERFECTFANCY must provide the Customer with a Product free from hidden defects which would make it unsuitable for the use for which it is intended or which reduce this use to such an extent that the Customer would not have acquired it or would have only given one less price if he had known them. This guarantee can only be exercised by the Customer on the condition that the latter informs NOTPERFECTFANCY within 2 years from the discovery of the defect. In the event of a hidden defect, the Customer can choose between returning the Product and having the price inherent in the Order refunded, or keeping the Product and having part of the price refunded. In all cases, it will be up to the Customer to prove that they meet the conditions of the guarantee. In the event of a lack of conformity and hidden defects, the Customer is invited to contact Customer Service so that a solution can be found.

Limitation of liability

NOTPERFECTFANCY cannot be held liable under any circumstances for any loss or damage which does not result from a failure by NOTPERFECTFANCY to fulfill one of its obligations. NOTPERFECTFANCY cannot be held liable in the event that the non-performance of its obligations is attributable to the actions of a third party, to the fault of the Client or to an event of force majeure as defined by article 1218 of the Civil Code and by case law. Likewise, NOTPERFECTFANCY cannot be held liable for any inconveniences or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses. Unless expressly stated otherwise, NOTPERFECTFANCY guarantees neither the accuracy nor the security of the information transmitted or obtained through the Site, due to the open nature of this Site and the possibility that errors may occur in storage and processing. transmission of digital information.

Applicable law – Disputes

These General Conditions of Sale are governed and interpreted under French law. In the event of a dispute relating to the application and/or interpretation of these General Conditions of Sale, the Customer has the option of contacting NOTPERFECTFANCY Customer Service.  NOTPERFECTFANCY informs the Customer that he also has the possibility, in the event of a dispute and before any legal action, to seek an amicable solution by resorting to a mediation procedure, in accordance with article L.211-3 of the Code of consumption. The use of mediation is an alternative mechanism which is not a prerequisite for taking legal action. In the event of a dispute, the competent court will be that of the defendant's place of residence or, at the plaintiff's choice, the place of actual delivery of the Product. This Site complies with French legislation.  NOTPERFECTFANCY cannot, under any circumstances, give any guarantee of compliance with local legislation which would be applicable in the event of access to the Site from other countries.
